Cosmetics Safety Assessment and Safety Information Management in Korea
A cosmetics responsible seller (화장품책임판매업자) in Korea must already prepare and keep product-level safety data for products labelled or advertised for infants or children, and report safety information such as adverse events to the Ministry of Food and Drug Safety (MFDS, 식품의약품안전처). The cosmetics safety assessment (화장품 안전성 평가) introduced by the amended Cosmetics Act (화장품법) promulgated on 30 December 2025 will be phased in from 1 January 2028 by business and product category, and is not yet in force.

The cosmetics safety assessment (화장품 안전성 평가) requires a cosmetics responsible seller to prepare product-level safety assessment data before distribution or sale, have it reviewed by a safety assessor and keep it; it will be phased in from 1 January 2028 by business and product category and is not yet in force. In force now are product-level safety data for products labelled or advertised for infants or children, and rapid (within 15 days of becoming aware) and periodic (within one month after each half-year) safety information reports to the Ministry of Food and Drug Safety (MFDS). YouSun Administrative Agency supports data lists and the preparation and filing of reports, but does not perform the safety assessor's review or testing.

If a cosmetic's name includes words like 'baby' or 'kids', do we need product-level safety data in Korea?
Short answer The rule covers specifically labelling the primary or secondary packaging as for infants or children, including where the product name contains an expression about infants or children. In that case all product-level safety data must be prepared and kept before labelling.
- The packaging or product name uses an infant or children's expression Prepare the three types of product-level safety data before labelling.
- Only advertising (internet, leaflets, etc.) specifies use by infants or children, with no packaging label Advertising is also covered, so prepare the same data before advertising (door-to-door advertising and demonstrations are excluded for children's cosmetics).

Short answer Prepare and keep all three before labelling or advertising: a description of the product and manufacturing method, safety assessment data for the cosmetic, and proof of efficacy and effects. Children means ages 4 to 13 and infants age 3 and under.
- Data can be obtained from the overseas manufacturer Obtain manufacturing method and ingredient data and organise it into Korean-language documents.
- Proof of efficacy and effects is insufficient Adjust the labelling or advertising claims to what the data can prove, or consider tests by a testing institution.
- Documents
- Description of the product and manufacturing method, safety assessment data for the cosmetic, proof of efficacy and effects, import management record
- Timeline
- Prepare before labelling or advertising / in practice, time for the overseas manufacturer's reply is added
A consumer says they were hospitalised after using our cosmetic. How many days do we have to report to MFDS?
Short answer Hospitalisation or extended hospitalisation is a serious adverse event, so file a rapid report to the Minister of Food and Drug Safety with a cosmetics adverse event report within 15 days of becoming aware. It can be reportable even if a causal link with the product is not proven.
- A serious adverse event such as death, a life-threatening condition, hospitalisation or persistent loss of function File a rapid report with the cosmetics adverse event report within 15 days.
- A non-serious adverse event Include it in the cosmetics safety information list for the half-yearly periodic report.
- Documents
- Cosmetics adverse event report, product name, batch number and expiry date, period of use and symptom information
- Timeline
- Within 15 days of becoming aware
Do minor skin irritation complaints also have to be reported to MFDS as cosmetics safety information?
Short answer Safety information not subject to a rapid report is compiled into the cosmetics safety information list and reported periodically to the Minister of Food and Drug Safety within one month after the end of each half-year.
- A general cosmetics responsible seller or customized cosmetics seller Prepare and file the list every half-year.
- Two or fewer regular employees selling only cosmetic soap made in-house The periodic report may be skipped.

We found a prohibited ingredient in a cosmetic on sale in Korea. When must the recall plan be filed?
Short answer Take immediate measures such as suspending sales and submit a recall plan to the head of the regional MFDS office within 5 days of learning that the product is subject to recall. Cosmetics using prohibited ingredients are hazard grade A, so state a recall period within 15 days from the start of recall.
- Hazard grade A Prepare the recall plan with a recall period within 15 days.
- Hazard grade B or C Prepare it with a recall period within 30 days.
- Filing or recall within the deadline is difficult Request an extension from the head of the regional MFDS office, giving reasons.

To estimate the cost of a cosmetics safety assessment in Korea, which preparation items should we look at first?
Short answer The scope of preparation depends on the number of products, whether ingredient safety data can be obtained, and whether safety assessor review and additional testing are needed. The scope and retention period of the assessment data are to be set by Ordinance of the Prime Minister, so for now start by organising the product list and the status of ingredient data.
- Data can be obtained from ingredient suppliers and manufacturers Build the data list and supplement only the missing items.
- Ingredient data is lacking or testing is needed Consider commissioning a testing institution (testing is not part of our work).
- Documents
- Product list, full ingredient list and ingredient specifications, ingredient safety data, product standard document
- Timeline
- Not yet in force / in practice, collecting ingredient data takes the longest
What does an administrative agent in Korea actually do for cosmetics safety data preparation?
Short answer Under a written mandate, we review timing, organise data lists and collect ingredient data, support preparation of product-level safety data for infant products, prepare and file safety information reports and recall forms, and handle supplementation. We do not perform the safety assessor's review, testing or inspection, or medical assessment of the causal link of adverse events.
- Preparing for the safety assessment start date We organise the start-date category and product data lists.
- A report such as an adverse event or recall is required We prepare the report and attachments and support filing within the deadline.
- Documents
- Letter of authorisation, product list, ingredient and manufacturing data, adverse event intake records, sales records
- Timeline
- Within the reporting deadlines (15 days, one month after each half-year, 5 days)

What is the cosmetics safety assessment system?
Before distributing or selling a cosmetic product, a cosmetics responsible seller must prepare, for each product, data that can prove the product is safe (cosmetics safety assessment data, 화장품 안전성 평가 자료), have it reviewed by a safety assessor (안전성 평가자) with education or experience in cosmetics safety, and then keep it. The system was created by the amended Cosmetics Act promulgated on 30 December 2025.
Excluded are (1) responsible sellers who broker or hand over cosmetics for import-agency-type transactions (e-commerce only), and (2) responsible sellers specified by Ordinance of the Prime Minister considering factors such as sales size.
The Minister of Food and Drug Safety may require the safety assessment data to be submitted where, for example, a public health risk has been raised, and the seller must comply unless there is a justifiable reason. Where the seller is a small or medium enterprise, the Minister may provide administrative, financial and technical support such as guidance and training on how to prepare the data and the provision of ingredient safety data. The amended Act also allows the Minister to designate a Cosmetics Safety Information Center (화장품안전정보센터) to provide technical support and advice on safety assessment, ingredient safety information and support for training safety assessors.
Detailed standards such as the safety assessor's qualifications and the scope and retention period of the assessment data are to be set by Ordinance of the Prime Minister and are not yet in the Enforcement Rule.
When does the cosmetics safety assessment apply?
It is not yet in force, and the start date depends on the business and product category.
(1) Businesses with annual production and import value of KRW 1 billion or more, or businesses that registered as a responsible seller after the amended Act was promulgated: 1 January 2028 for businesses selling products that passed functional cosmetics review or filed a report after promulgation; 1 January 2030 for businesses selling products first manufactured or imported and launched after promulgation; and 1 January 2031 for other businesses. (2) Businesses with annual production and import value under KRW 1 billion: 1 January 2031.
The production and import value is not turnover but the sum of the business site's production value and import value for the year before the promulgation date. Where a full year cannot be calculated because of a new business or suspension, the actual operating period of the previous year is converted to a one-year basis.
The duty applies to products manufactured or imported and sold after each start date. Once in force, failing to prepare or keep the data or to obtain the safety assessor's review is a ground for administrative sanctions and may lead to imprisonment of up to one year or a fine of up to KRW 10 million.
What safety data is required for cosmetics for infants and children?
This duty is in force now. A cosmetics responsible seller who wants to label or advertise a product as usable by infants (age 3 and under) or children (ages 4 to 13) must prepare all of the product-level safety data (제품별 안전성 자료) in advance and keep it.
The data consists of (1) a description of the product and its manufacturing method, (2) safety assessment data for the cosmetic, and (3) data proving the product's efficacy and effects.
Labelling means specifically stating on the primary or secondary packaging that the product is for infants or children, including where the product name contains an expression about infants or children. Advertising means specifically advertising this in media such as newspapers, broadcasting and magazines; leaflets, pamphlets, samples and admission tickets; the internet and computer communications; posters, signboards and electronic displays; video, books and publications; and door-to-door advertising or demonstrations (door-to-door advertising and demonstrations are excluded for children's cosmetics).
Retention: where the primary packaging shows an expiry date, from the date of labelling or advertising until one year after the expiry date of the last product manufactured or imported; where it shows a period after opening, until three years after the manufacturing date of the last product. Manufacture is counted from the manufacturing date by batch number, and import from the customs clearance date.
MFDS conducts a survey of how this data is prepared and kept every five years. Under the amended Act, from 1 January 2029 the second item becomes the new 'cosmetics safety assessment data', applying to products manufactured or imported and sold after that date.
When and how is cosmetics safety information reported?
Cosmetics responsible sellers and customized cosmetics sellers that become aware of new data on safety or efficacy, or adverse event information, that may directly affect public health must report it to the Minister of Food and Drug Safety and take the necessary safety measures. The method is set by the Regulation on the Management of Cosmetics Safety Information (화장품 안전성 정보관리 규정).
(1) Rapid report: on becoming aware of a serious adverse event (death or a life-threatening condition, hospitalisation or extended hospitalisation, persistent or significant disability or loss of function, congenital anomaly, etc.) or a foreign government measure equivalent to a sales suspension or recall, report within 15 days of becoming aware of it. Use the cosmetics adverse event report for the former and the cosmetics safety information report for the latter. The same applies where the Minister has ordered a report. (2) Periodic report: safety information not rapidly reported is compiled into the cosmetics safety information list and reported within one month after the end of each half-year. A responsible seller with two or fewer regular employees that sells only cosmetic soap it manufactures itself may skip the periodic report.
Reports may be filed through the MFDS website or by post, fax or information network, and the Minister may set a deadline to supplement a report that is inadequate or needs more data.
What do the post-market safety management standards require?
A cosmetics responsible seller must comply with the post-market safety management standards (책임판매 후 안전관리기준). It must appoint a responsible sales manager (책임판매관리자) and have enough staff for safety assurance work, and must have the responsible sales manager:
(1) collect and record safety management information from academic societies, literature and other research reports (2) promptly review and record the information, and where action is needed take safety assurance measures such as recall, disposal, sales suspension, revision of package inserts or reporting to the Minister (3) report the safety assurance plan in writing and keep a copy, and record and keep the decisions, instructions and results of measures (4) oversee safety assurance work and record that it is carried out properly
Responsible sellers engaged in import-agency-type transactions must also comply with these standards and the safety information reporting duty. Breach of these compliance duties may lead to a fine of up to KRW 2 million or administrative sanctions.
What is the procedure when a hazardous cosmetic must be recalled?
A business operator that learns that a cosmetic harming or likely to harm public health is in distribution must recall it or take the measures needed for recall without delay, and report a recall plan in advance.
(1) Take immediate measures such as suspending sales, and submit a recall plan to the head of the regional MFDS office within 5 days of learning that the product is subject to recall. Attach a copy of the manufacturing or import record for the item, records of sales volume and dates by buyer, and a document stating the reason for recall. (2) State a recall period of within 15 days from the start of recall for hazard grade A (가등급, e.g. cosmetics using prohibited ingredients), or within 30 days for grades B and C (나·다등급). If this is not feasible, request an extension giving reasons. (3) Notify sellers and others of the recall plan and keep evidence of notification for two years from the recall end date. (4) To dispose of recalled products, submit a disposal application, dispose of them in the presence of officials, and keep the disposal confirmation for two years. (5) When the recall is complete, submit a recall completion report with copies of the recall confirmations, disposal confirmation and evaluation report.
If four-fifths or more of the planned recall quantity is recovered, the administrative sanction for the violation is waived; partial recovery may reduce it according to the quantity recovered.
In what order should the safety data be prepared?
(1) Confirm scope: first check whether the product is labelled or advertised for infants or children, and which safety assessment start date applies (production and import value, registration date, functional cosmetics review or report, new launch). (2) Build the data list: for each product, set out the items for the product and manufacturing description, safety assessment and efficacy proof, and mark missing data. (3) Collect ingredient and manufacturing data: obtain ingredient specifications and safety data and product standard documents from ingredient suppliers and the cosmetics manufacturer (if manufacturing is contracted out). (4) Review and supplement: for infant and children's products, complete all data before labelling or advertising; once the safety assessment is in force, obtain the safety assessor's review. Where testing is needed, commission a testing institution. (5) Retention and reporting system: manage the data by retention period and set a schedule for rapid adverse event reports and half-yearly periodic reports.
What can an administrative agent help with?
Under a written mandate, YouSun Administrative Agency supports review of when the safety assessment applies, organising product-level data lists and collecting and organising ingredient data, preparing safety data for infant and children's cosmetics, preparing and filing cosmetics adverse event reports, safety information reports and safety information lists, preparing and filing recall plans, disposal applications and recall completion reports, and preparing documents in response to supplementation requests.
Review of the safety assessment data is carried out by a qualified safety assessor and testing by a testing institution; we do not perform these tasks. We also do not make medical assessments such as the causal link between an adverse event and a product, and we do not act as representative in appeals against administrative decisions. The adequacy of the data and any administrative sanction are decided by the competent authority.
Frequently Asked Questions
Q. Do export-only cosmetics need safety assessment data?
A. Products made only for export and not sold in Korea are not subject to the cosmetics safety assessment or the infant and children's product safety data rules, and may follow the rules of the importing country.
Q. Is a responsible seller doing only cross-border purchase agency (import-agency-type transactions) subject to the safety assessment?
A. A cosmetics responsible seller that brokers or hands over cosmetics for e-commerce import-agency-type transactions is excluded from the cosmetics safety assessment. It must still comply with the post-market safety management standards and the safety information reporting duty.
Q. Who can act as a safety assessor?
A. A person with education or experience in cosmetics safety as specified by Ordinance of the Prime Minister. The specific qualifications are not yet in the Enforcement Rule and are to be set by Ordinance of the Prime Minister. Our office does not act as a safety assessor.
Q. Can small and medium enterprises get support in preparing for the safety assessment?
A. Where a cosmetics responsible seller is a small or medium enterprise, the Minister of Food and Drug Safety may provide administrative, financial and technical support such as guidance and training on preparing the data and the provision of ingredient safety data. Whether and how support is provided is decided by MFDS.
Q. Does a small business that only makes and sells its own cosmetic soap have to file periodic safety information reports?
A. A cosmetics responsible seller with two or fewer regular employees that sells only cosmetic soap it manufactures itself may skip the periodic report. Rapid reports such as for serious adverse events are not covered by this exception.
Q. Does a diligent recall reduce administrative sanctions?
A. Recovering four-fifths or more of the planned recall quantity waives the sanction. Recovering one-third or more reduces registration cancellation to a business suspension of two to six months, or a suspension to two-thirds or less of its period. Recovering one-quarter to less than one-third reduces cancellation to a suspension of three to six months, or a suspension to one-half or less of its period.
