Is a rural homestay a permit or a report?

It is subject to a report, not a permit. A person who intends to run a rural homestay business must file a rural homestay business report with the head of the si/gun/gu as prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs or the Ministry of Oceans and Fisheries, and the same applies when changing the reported details or closing the business. Facilities used for this business are excluded from the lodging business report under the Public Health Control Act.

What are the requirements?

The applicant must meet all of the following: (1) be a resident of a rural, fishing or semi-rural area; (2) have lived continuously in that si/gun/gu for 6 months or more (not required for a person who inherited a house already used for the business); (3) use a detached house (detached or multi-household house) in which the applicant lives; and (4) use a detached house that the applicant owns. Certain persons with a set record of operating on a lease may file without meeting the ownership requirement in (4). The house's total floor area must be under 230 m² (no limit for a house designated as a cultural heritage), and the operator must observe the service and safety standards.

Which documents are needed?

Attach to the rural homestay business report form: (1) documents proving the right of use, such as a copy of the house lease (if the applicant is not the owner); (2) a drinking-water quality test report issued within the last 2 years (if groundwater is used to serve breakfast); and (3) documents proving inheritance (for an inherited house). The resident registration abstract, family relationship certificate, building register and building registry certificate are checked through shared administrative information.

What is the procedure?

(1) Check the residence and ownership requirements and the floor area → (2) submit the report and documents → (3) review of the report → (4) issue of the report confirmation certificate. The confirmation certificate and price list must be displayed in a visible place in the homestay house, and the entrance and website must show a rural homestay business sign.

How long does it take?

The head of the si/gun/gu must notify whether a report or change report is accepted within 10 days of receipt, and the report form also states a processing period of 10 days.

Which authority receives the report?

File the report with the head of the si/gun/gu with jurisdiction over the house's location.

What is the statutory fee?

The fee field on the rural homestay business report form reads "None". Training costs are separate.

Why is a report rejected or a penalty imposed?

Typical reasons confirmed in the law are failing the residency or residence-period requirement, failing the requirement of a detached house the applicant lives in and owns, or exceeding the floor-area limit. A person who files a report by fraud or other improper means and runs a rural homestay business faces imprisonment of up to 1 year or a fine of up to KRW 10 million, and a person who runs the business without filing a change report faces an administrative fine of up to KRW 1 million.
